Professional qualifications obtained in EU countries

The basic principle is that if the citizen is qualified in the country of origin to exercise a profession, this qualification also applies to exercise a profession in another EU country, both in establishment regime and as a temporary and occasional cross-border provision.

There are three different recognition systems depending on the type of qualification to be recognized:

- Automatic recognition system;
- Regime based on mutual trust between EU Member States (General System);
- Professional experience system.

In general, those citizens who wish to practice in Italy, either as employees or as self-employed, a profession that is regulated in their country of origin must obtain recognition of their qualifications submitting a request to the competent authorities that have 4 months to decide. Instead, if the profession is not regulated in his country, the recognition of the qualification is not necessary and he can start to practice it and the Directive 2005/36/CE is not apply.

Usually, the professional qualifications will be recognized as such; in the case of significant differences the competent Italian authority may require additional proof, like a training (maximum 3 years) or an aptitude test.

The documents to be submitted for professional recognition depending on the professional title of which recognition is sought. It is advisable to request information to Italian Embassy or Consulate in the country of origin or visit the websites of the Italian authorities.

Generally, the required documents for Italy EU citizens are:

- Copy of a valid identity document;
- Certified copy of academic qualifications;
- Statement of local value, issued by the Italian Embassy or Consulate;
- Certification of non-existence of criminal impediments;
- Certification about work activity carried out in the country of origin. In case of freelance work, the activity must be demonstrated by appropriate tax certification.

It should be noted that the bureaucratic process takes place in Italian language and any aptitude test or training required occur in the Italian language. Therefore, pursuant to art. 53 of Directive 2005/36/EC, the recipients of the recognition must have the necessary language skills to practice the profession in Italy.

The professional recognition is regulated by the European Directive 2005/36/EC.
The European Directive 2005/36/EC and Italian legislative decree (DPR 394/99, Art. 49-50 and DPR 334/04 - Italian only), extend to non-EU citizens the opportunity to obtain the recognition of professional qualification.
